Santiago Court of Appeals declares inadmissible protection appeal filed against AFP Modelo

Between Monday and Tuesday of this week, seven protection appeals were filed against AFP Modelo for delays in payment of 10%.

One of them was admitted to the Santiago Court of Appeals by Guillermo Garrido Parra, where he indicated that he is representing more than 160 people, and this Thursday the First Chamber of the Court declared the appeal inadmissible.

Along these lines, the Chamber chaired by Minister Miguel Eduardo Vázquez Plaza and made up of Minister Elsa Barrientos Guerrero and Minister Inelie Durán Madina affirmed that “the appeal for protection is intended to reestablish the rule of law when it has been broken by arbitrary or illegal acts or omissions that threaten, disturb or deprive the legitimate exercise of any of the guarantees strictly numbered in article 20 of the Political Constitution of the Republic, leaving other legal actions safe ”.

Therefore, in their decision, the ministers indicated that “in the presentation made in these records, there are no measures that this Court can take with respect to the facts denounced, which is why the rule of inadmissibility established in the second paragraph of the numeral 2 of the Agreed Order of the Hon. Supreme Court on Processing the Resource for the Protection of Constitutional Guarantees. And in accordance, in addition, with the provisions of the Agreed Order of the Hon. Supreme Court on processing and ruling of the protection appeal ”.
