A florist was sentenced by criminal order for having offered her compositions on a self-service shelf, installed in front of her store. For her, the sanction is totally excessive.

Manuela Achermann of Schmiedrued (AG) is still in shock. The 39-year-old florist must pay 1320 francs for having offered for sale some flowers and decorative items during confinement. The mother had indeed closed her small store, as ordered by the Confederation, but had installed in front of her shop a shelf allowing customers to serve themselves. At least until April 3, the day the police knocked on his door asking him to remove his shelf.

More than a month later, the 30-year-old received a criminal order from the Aargau Public Prosecutor’s Office. He sentenced her to a fine of 500 francs, a suspended sentence of 30 days-fine of 70 francs as well as court costs of 820 francs.

No essentials

Manuel Achermann is annoyed: “No one, neither the Confederation, the canton nor the commune, knew how to tell me whether a self-service sale was prohibited or not.” For the Argovian, 1320 francs is a very large sum of money, which she can in no case pay at once. “My workshop is only open two days a week. It’s more of a hobby than a source of income. ”

Both the police and the Public Prosecutor’s Office assure them that it was clear from the start that self-service sales were prohibited for florists since flowers are not essential products.
