PT Aneka Tambang Tbk Loses Another Legal Battle Against Surabaya Conglomerate: Must Pay 1.1 Tons of Gold

PT Aneka Tambang Tbk suffered another defeat against conglomerate from Surabaya, Budi Said. This time the state-owned company lost at the Judicial Review (PK) level against the ‘crazy rich’ Surabaya.

“The ruling rejects the PK application submitted by PT. Aneka Tambang Tbk (abbreviated as PT. Antam Tbk) represented by Nicolas D. Kanter as Main Director,” reads the court decision, quoted from the Supreme Court website, Monday (18/9/2023).

The decision was made by the chairman of the assembly, Yakup Ginting, with members Nani Indrawati and M Yunus Wahab. As for the replacement registrar, Prasetyo Nugroho. Also among the PK respondents are Eksi Anggraeni and Endang Kumoro, et al.

“Breaking up September 12 2023,” said the information.

With the rejection of this PK application, the cassation decision submitted by Budi Said has permanent legal force. Namely, the Supreme Court required PT Antam to pay 1.1 tons of gold or the equivalent of IDR 1,109,872,000,000 to Budi Said.

Budi Said vs Antam case

The case started when Budi Said bought 7 tons of gold from Antam in 2018. However, during his journey, Budi Said only received 5,935 kg. Feeling aggrieved, the conglomerate which owns a property company in Surabaya sued a number of parties. That is:

1. PT Aneka Tambang Tbk., (or abbreviated as PT ANTAM TBK) as Defendant I
2. Endang Kumoro as Defendant II
3. Misdianto as Defendant III
4. Ahmad Purwanto as Defendant IV
5. Exclusion of Anggraeni as defendant V

Initially, Budi Said won at the Surabaya District Court (PN). But Budi Said lost on appeal. Budi Said finally filed an appeal. Tit for tat. The appeal was granted.

“Declare that Defendant I is responsible for all actions and all legal consequences carried out by Defendant II, Defendant III and Defendant IV. Sentence Defendant I together with Defendants II, III, IV, jointly and severally to hand over gold weighing 1,136 (one thousand one hundred and three “twenty-six) kilograms of Antam gold bullion to the Plaintiff or if the gold weighing 1,136 (one thousand one hundred and thirty-six) kilograms is not handed over then it will be replaced with money equivalent to the price of gold at the time of implementation of this decision,” said Supreme Court spokesperson, supreme judge Andi Samsan Nganro in July 2022.

1,136 kg is the same as 1,001,136 grams. If 1 gram of Antam today is IDR 898 thousand, then the money that Antam must return is IDR 1.123 trillion. Apart from that, Eksi Anggraini also has to provide material compensation to Budi Said, who is known as Surabaya’s ‘crazy rich’.

“Sentenced Defendant V to pay material losses to the Plaintiff amounting to IDR 92,092,000,000.00 (ninety-two billion ninety-two million rupiah),” said Andi Samsan Nganro at that time.
