Proposed Amendment to Act on Restriction of Trade on Sundays and Holidays

Last week, a draft act on the restriction of trade on Sundays and public holidays and on certain other days, authored by the Ministry of Labor and Social Policy, was published in the list of legislative and program works of the Council of Ministers. This is intended to be a response to the problem that appeared this year in the calendar of Sundays excluded from the trade ban. It turned out that in 2023, one of the two trading Sundays assigned to December will fall on Sunday, December 24, which is Christmas Eve.

“The draft bill provides for an amendment to the provisions of the Act on the restriction of trade on Sundays and holidays and on certain other days, according to which Sunday, December 24, 2023 will be a day covered by the prohibition of (…) trading and performing activities related to trade and entrusting an employee with or employed person to perform work in trade and perform trade-related activities,” it was written then.

As added, “it is proposed to establish a so-called trading Sunday on December 10, 2023, which will allow the implementation of purchasing plans – in this case, however, it is proposed to limit trading to 2 p.m..”

“Due to the fact that the restriction of trade on Sundays is subject to statutory regulation, it is necessary to take legislative action and it is not possible to achieve the above-mentioned objective of the draft act by other means,” it was noted.

“Taking into account the fact that in 2023 one of the two trading Sundays preceding the first day of Christmas falls on December 24, i.e. Christmas Eve, it is proposed to amend the provisions of the Act on the restriction of trade on Sundays and holidays and on certain other days, according to which Sunday, December 24 will be a day subject to a trading ban,” it was written.

The Act gradually introducing the Sunday trading ban entered into force on March 1, 2018. From 2020, the trading ban does not apply on seven Sundays a year: the last Sundays of January, April, June and August, as well as on the Sunday before Easter and on two subsequent Sundays. preceding Christmas.

So this year, the first trading Sunday in December will be December 10. The next Sunday without a trade ban falls on December 17 this year.

The act restricting trade on Sundays provides for a catalog of 32 exclusions. The trade ban does not include, among others: postal activity, if the revenues from this activity constitute at least 40 percent. revenues from the sale of a given facility. Moreover, it does not apply to confectioneries, ice cream parlors, liquid fuel stations, flower shops, newsagents or cafes.

The penalty for breaking the Sunday trading ban is PLN 1,000 to PLN 100,000. PLN fine. In case of persistent violation of the regulations, the penalty is even more severe and it is not a financial penalty, but restrictions on freedom.
