Poultry Farmer in Brabant Forced to Shut Down Business Over Lack of Nature Permit: Court Ruling

A poultry farmer in Someren in Brabant has to shut down his business because it does not have a nature permit. The court decided this today. After twelve years, the company still does not have a nature permit. According to the province, the company would ultimately receive this, but the court does not share that opinion.

Expansion

The poultry farmer has been working on obtaining a nature permit since 2011. He bought the nitrogen space from four surrounding companies in order to expand his own company from 39,900 to 82,000 animals. But two of those companies had not had any animals for a while. And so no nitrogen was emitted.

Several environmental clubs went to court because, according to them, the expansion, although not on paper, could lead to more nitrogen emissions in reality. The Council of State agreed with them several times and has annulled the nature permits for poultry farming a number of times.

According to Omroep Brabant, the poultry farmer still had the stables built because the province expected to be able to issue a permit in the future. The zoning plan and the environmental permit were in order, but a nature permit was missing all along.

Disproportionate

Various nature associations requested the province to take action against the poultry company, but the province considered this disproportionate. He reasoned that the financial consequences for the entrepreneur would be many times greater than the consequences for nature if the company continued to exist, writes Omroep Brabant.

The court believes that the province must really intervene now. “There is currently no prospect of a permit being granted,” the court said. Poultry farming will be stopped in February after the current rearing round. The court also requires the province to monitor this.

The court can imagine that the outcome will be difficult for the poultry farmer to accept, “but it believes that he simply does not have a nature permit and therefore enforcement is justified”.
