Perpetrators of Planned Murder Cannot Be “Justice Collaborators”

“For the perpetrators, it can’t be JC (justice collaborator) main actors. This I straighten this. The law cannot,” said Junior Attorney General for General Crimes (Jampidum) of the Attorney General’s Office Fadil Zumhana in a press conference at the Attorney General’s Office, Jakarta, Thursday (19/1/2023).

He responded to the Witness and Victim Protection Agency (LPSK) who hoped the prosecutor would reduce the charges against the defendant Bharada E or Richard Eliezer because of their status. justice collaborator (JC) from LPSK to Ferdy Sambo’s aide.

In his demands, the prosecutor asked the judge to sentence Eliezer to 12 years in prison in the premeditated murder case of Brigadier J or Nofriansyah Yosua Hutabarat.

On that occasion, the Head of the Legal Information Center for the Attorney General’s Office, Ketut Sumedana, also said the same thing.

According to him, JC in premeditated murder is not regulated in Article 28 Paragraph (2) letter a of RI Law Number 31 of 2014 concerning Witness and Victim Protection (LPSK) and Supreme Court Circular Letter Number 4 of 2011.

As for the specific criminal acts that are regulated related to JC, among others are corruption, terrorism, narcotics crimes, money laundering crimes, trafficking in persons, and other organized criminal acts.

“He (Bharada E) is the main actor, so he cannot be considered as someone who must get JC. This is also in accordance with Number 4 of 2011 and the Law on Witness and Victim Protection,” said Ketut.

Previously, the prosecutor from the South Jakarta District Attorney’s Office (Kejari) demanded that Richard Eliezer Pudihang Lumiu alias Bharada E be sentenced to 12 years in prison, Wednesday (18/1/2023).

Bharada Eliezer was prosecuted for 12 years in prison because the prosecutor considered it legally and convincingly proven guilty of premeditated murder of Brigadier J.

According to the prosecutor, the premeditated murder of Brigadier Yosua was carried out together with four other defendants namely, Ferdy Sambo, Putri Candrawathi, Ricky Rizal or Bripka RR, and Strong Ma’ruf.

“Declaring that the defendant Richard Eliezer has been found guilty of committing the crime of participating in the premeditated murder as stipulated and threatened in the indictment of Article 340 of the Criminal Code in conjunction with Article 55 Paragraph (1) 1 of the Criminal Code,” said the prosecutor at the trial at the District Court (PN ) South Jakarta, Wednesday.

In this case, Ferdy Sambo has been charged with life imprisonment. Meanwhile, Strong Ma’ruf, Bripka Ricky Rizal, and Putri Candrawathi were demanded to be jailed for 8 years each.

The four defendants were proven by the prosecutor to have committed the premeditated murder of Brigadier J.

In the indictment, it is stated that the murder occurred because of a one-sided story from Ferdy Sambo’s wife, Putri Candrawathi, who claimed to have been harassed by Brigadier J in Magelang on 7 July 2022.

Ferdy Sambo then became angry and planned to kill Yosua involving Richard Eliezer, Ricky Rizal, and Strong Ma’ruf at his official residence at the National Police Complex, Duren Tiga, South Jakarta, on 8 July 2022.
