Paderborn’s ex-manager has not received any money since May: Przondziono wants to sue for a salary – SCP

Part of the process separated

The legal dispute will not only concern the labor court in the future. Part of the proceedings was separated and referred to the Paderborn regional court. The Chamber of Commercial Law is responsible here.

Two courts for one dismissal? The immediate separation of the SCP from its Managing Director Sport could still be exciting at one point: The ex-professional has been under contract with the Ostwestfalen since September 2018, at that time as “Head of Sports Licensing”. His employer was SC Paderborn 07 GmbH and Co. KGaA, and Przondziono was an employee here as the right-hand man of the former manager Markus Krösche. That changed with Krösche’s departure towards RB Leipzig. His successor was known to be Przondziono in June 2019, who thus rose to the SCP leadership.

New employer

The club remained the same as SC Paderborn, but its new employer became a different company with SC Paderborn 07 Management GmbH. And right here there is also a dispute. While the SCP, represented by sports law expert Christoph Schickhardt, is of the opinion that with Przondzionos’ promotion, combined with the new basic salary (allegedly 20,000 euros per month), the old employment contract (running until June 30, 2021) has been canceled, Przondzionos is Frankfurt lawyer Soldner disagrees.

The labor court must therefore first clarify whether the existing employment contract was automatically canceled with the appointment of Przondzionos as managing director of Sport. According to WESTFALEN-BLATT information, the termination of the old employee relationship should at least never have been fixed in writing. SC Paderborn has meanwhile also terminated Przondziono’s old salaried employment contract, but from a legal point of view the club has not yet solved all the problems. For example, the Chamber still has no grounds for termination.

Statements harmful to the club

The Chamber of Commerce, on the other hand, is dealing with Przondzionos’ immediate dismissal as managing director. This took place on May 4, 2020, two weeks after his release. Here, the club also provided a reason with “statements that were harmful to the club when saying goodbye to the team”. With a view to the wage reduction due to the corona pandemic, Przondziono is said to have said at the time: “You had to forego part of your salaries to pay the new manager.”

While it will continue to be negotiated before the labor court on December 10th, there is still no appointment at the regional court.
