Provincial Sanitary Inspector in Gdańsk, it revoked three decisions imposing administrative fines on an entrepreneur for not complying with the ban on running gyms and fitness clubs. The decision was announced by the Ombudsman for Small and Medium Enterprises, who acted as part of the proceedings.

“On the basis of the findings of the inspection, in which it was established that the clubs are active, the body of first instance, with three decisions, imposed fines on the entrepreneur for the entrepreneur’s failure to prohibit the operation of gyms and sports clubs” – we read in the press release of the SME Ombudsman.

SME spokesman appealed against this decision. The appeal indicated that there had been “infringement of the provisions of the Code of Administrative Procedure and the lack of grounds for issuing the decisions challenged by the party, the Defender requested that the contested decisions be revoked and the proceedings of the first instance were discontinued in full”.

The Voivodship Sanitary Inspector “revoked the decisions in full” and referred the cases for reconsideration to the body of first instance. According to WIP, the case requires an unequivocal determination which entity performed activities in sports clubs belonging to the entrepreneur and what services were provided in these facilities.
