The magistrates of the District Court in Plovdiv took the most severe measure “detention in custody” against the 49-year-old SANS employee Borislav Hristov, a reporter told “Maritsa”.
He was caught on November 11 after taking a bribe of BGN 750 from a Karlovo farmer. The agent told the blackmailers that a signal had been filed against him that he was illegally misappropriating funds granted to him by the State Fund for Agriculture. In order not to give it to the prosecutor’s office, Hristov asked for BGN 1,500, which was given to him. He then asked for another BGN 1,000, but received BGN 750, which pushed him straight into custody.
The Penal Code provides for imprisonment of up to 6 years and a fine of up to BGN 5,000 for Hristov.
According to the court, in a measure other than detention, there is no danger of absconding, but there is a real danger of committing a crime. The high public danger of the perpetrator is derived from his specific actions and the persistent criminal will shown in the repeated extortion of the victim at the request of a bribe, so as not to signal the competent authorities for alleged violations. According to the court, in this case the public interest should take precedence over the personal and despite the deteriorating health of the accused and his family and work involvement, the only adequate measure is detention.
The ruling is not final and is subject to protest and appeal before the Court of Appeal – Plovdiv on November 18 at 10.00.
