New York State Law Prevents Employers from Demanding Access to Personal Electronic Accounts: Here are Other Laws Coming into Effect in 2024

Due to his activity on social networks, Many New Yorkers have been exposed to sanctions and dismissals from current or potential employers when they are looking for work, but starting in March a new law will prevent this.

In March 2024 the state law S2518Awhich “Prohibits an employer from requiring an employee or applicant to disclose any means of accessing a personal electronic account.”

“There are a lot of people who have said that a lot of freedom is being lost if people are required to grant access to employers,” he told Fox News employment attorney Amy Feldman. “Your employers cannot demand access to accounts you use exclusively for personal reasons.”

However, If your company pays for an account on networks like LinkedIn, for example, or if you access private accounts on a company device or network, the law may not apply..

Several other laws will take effect in 2024 in the state and/or City of New York. Below are some of them:

Increase the minimum wage
Starting January 1, New York State will increase minimum pay to $16 per hour for employees in New York City, Long Island and Westchester.

Inclusive hair salon
Legislation S.6528A/A.6927A requires cosmetologists to receive training on all hair types and patterns. “We now know more than ever the positive impact that inclusion has on communities, and in New York we are taking steps to ensure equity for everyone, from health care to hair care,” said Governor Kathy Hochul it’s a statement in November.

Statute of limitations
Starting February 15, the New York State Human Rights Law will extend the statute of limitations for filing complaints of illegal discrimination, counted from the date of the alleged discrimination. The previous deadline was one year, except for sexual harassment claims, which could be filed within a three-year statute of limitations.

“Dog factories”
A law will ban the sale of dogs, cats and rabbits in New York retail stores with the goal of “preventing the purchase and sale of animals from large-scale abusive breeders who lack adequate veterinary care, feeding or socialization.” It is an attempt to attack commercial breeding operations described by critics as “puppy factories” and will come into effect in December 2024.

Free menstrual products for students
Law S5913A requires that menstrual products be offered free of charge in private schools as well. “From simply updating how certain products are referred to to expanding access to vital resources for those who need them most, as time progresses, our laws should too,” Hochul added.

Contracts of deceased tenants
Legislation S.548/A.458 allows the executor (“executor”) of a deceased tenant to terminate his or her tenancy to avoid unnecessary costs to assets and free up homes.

Water Quality at NYCHA
The Public Housing Authority (NYCHA) will have to notify tenants in writing about water shutoffs and when water is unsafe for drinking or cooking. “New York has the highest percentage of renters of any state in the country, and I am proud to sign this legislation that will ensure renters have critical additional protections,” Hochul commented.

“It is unacceptable that too often (tenants) face uncertainty when it comes to the quality of the water coming from their taps. When test results indicate a potential danger, residents must be notified immediately,” said Assemblywoman Linda B. Rosenthal, sponsor of this law (S.7456/A.7273).

Crime statistics on university campuses
Universities will be required to publish statistics about crime on their campuses on their websites, as well as investigate hate crimes. Institutions will also be responsible for informing students about how they plan to prevent them.
