New Egyptian Rent Law Updates: What You Need to Know

The old rent law currently presented to the House of Representatives table is one of the most important laws that citizens in the Egyptian street are concerned about, as it is the law that regulates the relationship between landlords and tenants and preserves the rights of each towards the other.

Some store tenants with old lease contracts wondered about the legal position of the lease contract in the event of the death of the original tenant.

Amr Fouad Awad, the lawyer, said that the old rental law took into account the economic dimension of the family in the event of the death of the original tenant and specified the number of heirs to whom the rental contract was extended.

He pointed out that the ruling of the Court of Cassation issued last March ended by amending the following text: “If the property is leased to engage in a commercial, industrial, professional, or craft activity, the contract does not end with the death of the lessee and continues for the benefit of those who use the property among his heirs in the same activity that was practiced by the original lessee in accordance with For the contract, spouses and relatives up to the second degree, males and females, minors and adults, apply in this case either in person or through a representative.

He pointed out that the recent ruling of the Court of Cassation stated in the amended text: “The contract shall not continue with the death of any of the holders of the right to remain in the property except for the benefit of the beneficiaries of the heirs of the original lessee and no one else, and for one time. Article Five stipulates that this law shall be published in the Official Gazette, and shall be implemented from The day following the date of its publication.” This means that the lease contract does not continue with the death of one of those who have the right to remain in the property except once, for the benefit of the beneficiaries of the original tenant’s heirs and not the heirs of his heirs, even if they are his second-degree relatives. If one of these beneficiaries dies, the contract does not continue. For the benefit of any of his heirs.
