NEPLP repeatedly loses “Prohibited Method” for Covid-19 Vaccine Efficacy Program / Article

The court decided to annul the decision of NEPLP of June 17 last year and close the administrative violation case.

The judgment may be appealed to the Riga Regional Court within ten working days of its notification.

CONTEXT:

Last year, the NEPLP decided to impose a fine of 4,000 euros on the LTV program “Prohibited Method” for the information released on March 29 regarding the effectiveness of the vaccine against Covid-19.

LTV appealed the penalty. The Court of First Instance decided to dismiss the action, while the Court of Appeal decided to remit the case to the Court of First Instance.

The main reason was that the judgment of the judge of the court of first instance was not sufficiently motivated, it was established that it was not formed in accordance with the requirements of the law and should therefore be annulled. The grounds of the voluminous judgment consist essentially of quotations from the case-law, but lack an assessment of the facts of the case. This was also stated in the appeal.

“Prohibited Technique” in the experiment tested antibodies to Pfizer ‘s second vaccine and AstraZeneca’ s first vaccine. The Swan Laboratory test found that AstraZeneca had fewer antibodies after the vaccine.

Dace Zavadska, Chair of the National Council for Immunization pointed outthat the measurement of the development of antibodies after vaccination against Covid-19 does not provide sufficient conclusions as to whether the amount of antibody is sufficient or not. Thus, the “Prohibited Method” experiment just confused people’s minds. At the same time, Zavadska does not plan to take any action against journalists.

LTV does not consider that the information on the effectiveness of the AstraZeneca vaccine in the Prohibited Method program would be withdrawn and that the media team would not be penalized in any way by the media. Accordingly media watchdogs fined LTVwho appealed against that decision to the Court, and the court overturned the sentence.
