According to the legal community on the 4th, the Chuncheon District Court Wonju Branch Criminal Division 1 (Chief Judge Lee Soo-woong) sentenced A (52), who was indicted on charges of violating the Special Act on the Punishment of Sexual Violence Crimes (quasi-rape of persons with disabilities), to seven years in prison.
In addition, employment restrictions for children, youth, and disabled people were restricted for five years, and orders were placed to complete a 40-hour sexual violence treatment program.
Mr. A, who runs a motel in Wonju, was indicted on charges of sexually assaulting Mr. B, an intellectually disabled person whom he had contacted after seeing a motel job advertisement on the morning of December 3 last year, after meeting her near the bus terminal and taking her to the motel under the pretense of helping her hire her.
During the trial, Mr. A claimed, “It is true that I entered the motel room with Mr. B to help him find a job, but I did not commit adultery and I was not aware that the victim had an intellectual disability.”
However, the court did not accept Mr. A’s claim, saying that, considering the legally adopted and examined evidence, the main parts of Mr. B’s statement were highly credible, and that it could be fully acknowledged that he committed sexual assault by taking advantage of Mr. B’s difficulty in resisting due to his intellectual disability. .
In addition, he found Mr. A guilty, saying that there was no reason to take her into a motel room to help her find a job, and because she took her to another motel even though she owned a motel, it seemed clear that the intention was to sexually assault the victim. .
The court said, “Considering that he committed the crime under the pretext of an interview, etc., knowing that he had an intellectual disability, the guilt is heavy and the nature of the crime is bad. Instead of reflecting, he is only trying to avoid guilt by citing the limitations of the victim’s statement.” “This was taken into consideration in sentencing,” he said.

This case, in which Mr. A and the prosecution appealed against the first trial ruling, is currently in the second trial at the Chuncheon Chamber of the Seoul High Court.
The investigation into this case began when an employee who saw Mr. B buying a pregnancy test at a convenience store near the victim B’s house heard from Mr. B that he was ‘buying a pregnancy test because he was sexually assaulted’ and reported it to the police.
A total of four men, including Mr. A, were identified as the perpetrators of the so-called ’20s intellectually disabled sexual assault case’ that caused an uproar in the mountain village.
Among them, the CEO of a bakery in his 50s who was indicted along with Mr. A was sentenced to 8 years in prison in the first trial, and the second trial is in progress at the Chuncheon Trial Division of the Seoul High Court, and one person who was indicted without detention is undergoing the first trial in Gangneung Branch.
The investigation of the other person was closed this spring due to his death due to an extreme decision.
