Ministry of Trade Finalizing Revision of Permendag Number 50: Business Actors Object to Price Limit for Cross-Border Goods

The Ministry of Trade (Kemendag) is finalizing the revision of the Minister of Trade Regulation or Permendag Number 50 governing the provisions for Business Licensing, Advertising, Guidance and Supervision of Business Actors in Electronic Trading (PPMSE).

However, there are still business actors objecting to the regulation on the price limit for imported goods entering Indonesia, aka cross-border, which cannot be below US$ 100 or Rp. 1.5 million (exchange rate of Rp. 15,000). Cross border are goods imported from abroad and reach the consumers directly.

“Not a protest (business actors). The name of the government listens to input. So from yesterday the minister received Shopee, accepted this, before it was decided,” said Secretary General of the Ministry of Trade Suhanto Friday (11/8/2023).

“(Response of e-commerce, what is the consideration that the revision has not been completed?) That is the US$ 100 limit,” he added.

So currently the Minister of Trade Zulkifli Hasan alias Zulhas is still open for input from business actors. In essence, the Ministry of Trade wants the revised rules to be in favor of all segments, both business actors and MSMEs.

“So, this will continue tomorrow tomorrow, he is this person, don’t make decisions later that are not applicable, that’s all. Actually, in substance, what he always conveys is what he conveyed,” explained Suhanto.

Suhanto explained that the harmonization process is still ongoing. “This will still be discussed between ministries/institutions with industry and the Ministry of Finance,” he continued.

Previously, Zulhas emphasized that later in the revision of the rules there will be a limit on the price of foreign goods entering Indonesia online, aka cross-border, that is, it cannot be below US$ 100 or Rp. 1.5 million (exchange rate of Rp. 15,000). Cross border itself is goods that are imported from abroad and reach consumers directly.

Later the sales rules for e-commerce and social commerce will also be differentiated. So for social commerce which is social media but also provides buying and selling transactions, it must have a trading business license.

“If it’s just social, it’s just social (social media), if it’s commerce it means selling. Later for selling you have to have another license to trade, two permits,” he told detikcom at the detiknetwork office, Tendean, South Jakarta, Tuesday (8/8/2023 ).
