Man smashes the windshield of a car with his hand

One morning last October, a 23-year-old smashed the windshield of a car in eastern County with the flat of his hand. Now the man was before Judge Carina Särve for intentional damage to property. For his crime, the 23-year-old received a penalty order of 40 times 60 euros, equal to 2400 euros. He had Rouven Colbatz, the lawyer, lodge an objection to this.

Colbatz argued that the daily rate was too high. His client is currently unemployed and only gets 949 euros in unemployment benefits. In addition, the number of daily rates set is too high. According to the repair invoice, the damage was only 240 euros, not 700 euros as originally assumed. The defender pleaded for 20 fines of 30 euros. Judge Särve complied with the request of public prosecutor Wolfgang Voit, who had demanded 30 times 30 euros – equal to 900 euros. There are also significant procedural costs.
