Mahfud Suspected of Involvement in Rp. 349 Trillion Reports; MAKI to Oversee PPATK with Arteria Dahlan.


JAKARTA, KOMPAS.com – Member of Commission III DPR RI Arteria Dahlan warned the Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD and Minister of Finance (Menkeu) Sri Mulyani.

The warning is related to the threat of imprisonment for a maximum of 4 years for violators of Article 11 of Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes (TPPU).

“Everyone, including ministers, including the coordinating minister (Mahfud), who obtains documents or information, in the context of carrying out their duties, according to this law is obliged to keep these documents or statements confidential,” said Arteria Dahlan in a Working Meeting with PPATK at the Parliament Complex, Jakarta, quoted from Kompas TV, Tuesday (21/3/2023).

In Article 11 Paragraph (1) of the Law it is stated, “PPATK officials or employees, investigators, public prosecutors, judges, and everyone who obtains documents or information in the context of carrying out their duties according to Law 8/2010 are obliged to keep these documents or information confidential, except for fulfill the obligations according to Law 8 of 2010”.

In Article 11 Paragraph (2) it reads, “everyone who violates the provisions referred to in Paragraph (1) shall be punished with imprisonment for a maximum of four years”.

It is known, Mahfud had said that there were findings of suspicious transactions of IDR 300 trillion at the Ministry of Finance during the 2009-2023 period in a press conference on Friday (10/3/2023).

Mahfud said that the transaction indicated that there was an alleged ML.

Apart from Mahfud, Sri Mulyani on Monday (20/3/2023) also explained that there were 300 PPATK letters regarding a suspicious transaction value of Rp. 349 trillion which was sent to her party on March 13, 2023.

Arteria explained that there are sanctions for anyone who violates article 11 of Law Number 8 of 2010.

“This is serious. Later friends, we (members of Commission III DPR) will have the next session for clarification,” said Arteria.

Meanwhile, the Indonesian Anti-Corruption Society (MAKI) plans to report PPATK leadership to the National Police’s Criminal Investigation Agency (Bareskrim) next week.

This report plan was submitted by MAKI to follow up on Arteria’s statement regarding the potential for crime because PPATK had leaked the TPPU documents which have recently become a public discussion.

“Following up on the DPR’s statement stating that there was a crime submitted by PPATK at the Commission III meeting yesterday, then MAKI next week will make a report to the police regarding the follow-up to what was said by the Member of Commission III of the DPR that the process carried out by PPATK contains a criminal element,” said MAKI Coordinator Boyamin Saiman to Kompas.com, Thursday (23/3/2023).

Boyamin claims that this reporting plan is actually an effort to “defend” PPATK.

He emphasized that MAKI wanted to ensure to the police that PPATK’s actions were in fact correct.

Boyamin admitted to using “reverse logic” in defending PPATK.

“If this is said by the DPR to be untrue, then I try with reverse logic to follow the flow of the DPR by reporting it to the police on suspicion of disclosing secrets as per the law governing the PPATK and that will be subject to criminal penalties,” said Boyamin.

“Later I will ask the police to summon DPR friends who say it was a crime and this is accompanied by (data) that the DPR should be able to convey to the police,” he said.

He also believes that what the PPATK has done is not a violation of criminal law.

Because, what was conveyed was that PPATK is a global matter, not an individual person and no one is harmed by a single person.

“This is my reverse form of logic, then if later the police declare that there was no crime committed by the PPATK, then what the PPATK did is correct,” said Boyamin.
