The panel of judges passed a verdict ultra petite or the verdict exceeds the demands put forward by the prosecutor against the four defendants in the premeditated murder case of Brigadier N Yosua Hutabarat. The highest sentence was handed down by the judge against the former Kadiv Propam Polri Freddy Sambothat is, the death penalty.
The sentencing trial for the premeditated murder of Brigadier Yosua was held at the South Jakarta District Court since Monday (13/2/2023). The defendant whose sentence was first read was Ferdy Sambo, followed by the verdict for Sambo’s wife, Putri Candrawathi.
The sentencing trial then continued on Tuesday (14/2/2023). There were two defendants whose sentences were read out, namely Sambo’s driver, Strong Ma’ruf, and Sambo’s former adjutant, Bripka Ricky Rizal.
The following is a list of verdicts ultra petite handed down by the jury:
Sambo Death Sentence
Ferdy Sambo was found guilty of premeditated murder of his aide, Brigadier N Yosua Hutabarat. Ferdy Sambo was sentenced to death.
“Given Article 340 of the Criminal Code juncto Article 55 paragraph 1 and Article 49 juncto Article 33 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions juncto Article 55 paragraph 1 1 of the Criminal Code of the 1981 Law concerning the Criminal Procedure Code and other relevant legal regulations… please stand up,” Wahyu said at the South Jakarta District Court, Monday (13/2/2023).
After the former two-star general of the National Police stood up, Wahyu continued reading the verdict for Sambo.
“On trial, stated that the defendant Ferdy Sambo has been proven legally and convincingly guilty of committing the crime of participating in premeditated murder and without the right to commit acts of making the electronic system not function as it should,” Wahyu said reading out the verdict.
“Determined the death penalty against Defendant Ferdy Sambo,” he added.
The judge stated that there was no excuse or justification for Sambo. The judge also stated that there was no mitigating circumstances for Ferdy Sambo. This sentence was heavier than the prosecutor’s demands, namely life imprisonment.
Putri Candrawathi Sentenced to 20 Years Jail
Sambo’s wife, Putri Candrawathi, was also found guilty of being involved in the premeditated murder of the driver and his aide, Yosua. Just like when reading the verdict for Sambo, the judge also asked Putri to stand up from the prisoner’s chair.
“At the trial, it was stated that the Defendant Putri Candrawathi had been legally and convincingly proven guilty of intentionally and premeditatedly taking other people’s lives,” said Wahyu.
“Sentenced a sentence against the Defendant Putri Candrawathi in the form of 20 years in prison,” he continued.
The judge stated that Yosua’s murder occurred due to a false story about harassment that Putri told Sambo. The judge stated that things that incriminated Putri included her actions to tarnish the Bhayangkari organization to the point where it was complicated in court. This sentence was higher than the prosecutor’s demand, namely 8 years in prison.
