Leipzig: Federal Administrative Court negotiates the admissibility of diesel driving bans

The German Environmental Aid (DUH) and the Federation for Environment and Nature Conservation Germany (BUND) had sued for a corresponding change in the air pollution control plans in Hamburg, Kiel and Ludwigsburg.

The environmental associations were successful in the lower courts. However, the courts had allowed the appeal in Leipzig.

At certain measuring stations in the three cities, the limit value for nitrogen dioxide (NO2) has been exceeded for years. The cities had announced further measures that were supposed to bring improvements, but the courts took it too slowly.

With additional diesel traffic bans, exceeding the limit values ​​could be reduced more quickly, it said. Therefore, these should also be included in the air pollution control plans.

The way for driving bans in Germany was prepared by the Federal Administrative Court in February 2018. Driving bans are generally permissible, but must be proportionate, the highest administrative judge had decided.
