Legal Advice Sought on Disqualifying Rahul Gandhi: Congress Criticizes Speaker’s Move – Zee Hindustan Malayalam

CJM court in Surat yesterday sentenced Rahul Gandhi to 2 years imprisonment in defamation case. “How come the name Modi is behind the name of all the thieves? Nirav Modi, Lalit Modi, Narendra Modi… How come they all have the common surname Modi? The court has now sentenced Rahul Gandhi to two years in jail for this remark. The court has given him the maximum sentence that can be given in a defamation case. But the bail was granted. The court has granted Rahul 30 days to file an appeal.

At the same time, the Congress is gearing up to face the court verdict legally and politically. An emergency meeting of the opposition parties has been called in Parliament this morning. Besides, the Congress party is also holding a meeting. The meeting will be held at AICC headquarters at 5 pm, attended by Steering Committee members, PCC presidents, etc.

BJP MLA and former minister Purnesh Modi filed a complaint against Rahul Gandhi’s speech during the 2019 Lok Sabha election rally in Kolar, Karnataka, pointing out that Rahul’s remarks were a total insult to the Modi community. However, when the case reached the court, Rahul refused to apologize and settle. Chief Judicial Magistrate HH Verma passed the sentence after a four-year long legal battle. The prosecution urged in its pre-sentence argument that the member of the legislature himself had committed the offense and that the maximum sentence should be imposed.

Meanwhile, former Congress leader and eminent lawyer Kapil Sibal said that Rahul Gandhi was automatically disqualified from being a member of Parliament as soon as the sentence came. He opined that Rahul Gandhi would automatically be disqualified from membership of Parliament with that strange conviction. Kapil Sabal says suspension of sentence is not enough, only suspension or stay of judgment will allow him to continue as Member of Parliament.
