Legal Actions of TCC SP Explained by Lawyer Marina Bekalo in Ukraine: Can Summons Be Served and Medical Examination Required?

The lawyer explained whether such actions of the Territorial Center for Recruitment and Social Support (TCC SP) were legal.

Can, within the framework of mobilization in Ukraine? serve a summons to the one who is entitled to a deferment, and send to undergo a military medical examination (VLK) lawyer Marina Bekalo told the TSN.ua website in a commentary.

Thus, according to her, all conscripts, those liable for military service and reservists, without exception, must comply with the rules of military registration, regardless of whether they are subject to conscription.

“To be honest, the majority of men of military age do not comply with the rules of military registration, do not renew their registration data in the TCC and SP, including in the event of a change in marital status, place of residence, enrollment in education or expulsion, etc. And the TCC SP, which in turn may not know about the existence of the right to a deferment, has every reason to call a spouse of military age to clarify credentials, register for military service, send him to the Military Military Command, and only after that he will consider the question of the presence or absence of grounds for a postponement,” Marina Bekalo told TSN.ua.

Therefore, such a case with a man with many children in Rivne, who was recently served with a summons, is a fairly standard situation that should not cause concern, the lawyer emphasized.

If a man has not previously registered for military service at the age of 27 or changed his place of residence without registering for military service, has not undergone military registration, or has not updated his credentials, then TCK SP has the right call a military service member to update your credentials.

“To do this, he will require all available documents and data related to military records. For example, a diploma of education to determine the appropriate military specialty, data on health status. For this purpose, the person liable for military service is sent to the VLK,” Marina Bekalo explained to TSN.ua.

After passing the VLK and updating the TCC credentials, the joint venture must consider granting a defermentif there are grounds for this.

“In order to exercise the right to a deferment, a person liable for military service must submit to the TCC SP all the documents he has confirming the right to a deferment and, preferably, an application for a deferment. And in this case, the man is not subject to conscription for military service during mobilization. Therefore, in this case there are no violations of relevant legislation on the part of TCC JV. The man will go through the VLK, provide documents confirming the maintenance of minor children, and receive the right to a deferment from the TCC SP,” said Marina Bekalo.

Let us remind you that in Ukraine they want to mobilize another category of citizens. According to Evgeniy Diky, about 100 thousand people can be taken to the front.
