Content of the warning:
Lawyer Göktekin accuses the admonished of running an eBay shop just like his client. The lawyer Göktekin’s client offers electronic and household goods for sale via various online shop platforms (including eBay). This would also include headphones, headsets and accessories for smartphones. For this reason, the lawyer Göktekin’s client is in a competitive relationship with the admonished.
The admonished is offering his goods (hair clippers, razors, headphones, watches, etc.) on eBay as a private seller. Since the admonished person had placed over 80 sales advertisements on eBay, a private sale can no longer be assumed here. In addition, in the last verifiable transactions as a seller, the admonished person had repeatedly sold the same items. Here, a typical household sale can no longer be assumed.
Since the admonished was thus to be classified as a commercial seller, he had violated several competition law provisions. First of all, the warned person did not give the buyers proper cancellation policy. The buyer would also not be informed with whom the contract would be concluded. A link to the OS dispute settlement platform would also be missing.
With his behavior, the admonished violated competition law regulations.
Claims from the warning:
The warned person is asked to sign a cease and desist declaration subject to penalties. He is also asked to reimburse attorney’s fees in the amount of approx. 1,324 euros (after an amount in dispute of 30,000 euros).
