Judge rejects ex-partner’s claim in allowance affair, wait until summer for compensation

The Ministry of Finance does not have to prevent creditors from claiming money from ex-partners in the allowance affair. The ex-partners with debts have to wait for a compensation plan that is specially designed for them. The judge ruled this in summary proceedings brought by Roger Derikx.

Derikx and presumably thousands of other ex-partners have to wait at least until the summer for their compensation. Only then will the plan for this regulation be submitted to the House of Representatives.

The court ruled that the chance that Derikx will be eligible for this partner arrangement is ‘real’ and that he will have to wait for it. However, the judge instructs the state to contact the creditor who has garnished Derikx’s income to determine whether a postponement is possible.

Parting

The family of Roger Derikx had to deal with collections from the tax authorities from 2010 onwards. According to Derikx, the resulting tensions and financial problems led to a divorce in 2014.

Derikx’s ex-wife has been recognized as a victim, but Derikx himself is not. This is because the Tax and Customs Administration only looks at the parent who once applied for the childcare allowance for the compensation. The reason for this is that some affected families would otherwise receive twice the 30,000 euros that is intended for all affected households.

Pause button for debt

The result is also that ex-partners such as Derikx cannot make use of other schemes. For example, debts are not forgiven and the so-called moratorium, the pause button for their debts, is now coming to an end.

After a long period of financial problems, Derikx has a job and a house again, but because of this situation, he is now again faced with wage garnishments and bailiffs. An estimated 7,000 to 9,800 other ex-partners will find themselves in the same position in the coming months.
