Jiwasraya case, Benny Tjokro sued by jail for life

Commissioner of PT Hanson International Benny Tjokrosaputro sentenced to life imprisonment and a fine of Rp. 5 billion subsidiary 1 year in prison. Benny is believed by prosecutors to be guilty of corruption and enriched himself in collaboration with three former officials Jiwasraya worth Rp. 16 trillion.

“Demand that in this case the panel of judges at the Corruption Court at the Central Jakarta District Court will adjudicate to decide: To declare the defendant legally and convincingly proven guilty of joint corruption and money laundering,” said the public prosecutor, KMS Roni, at the Jakarta Corruption Court, Jalan Bungur Besar Raya, Central Jakarta, Thursday (15/10/2020).

“Sentenced to life imprisonment, a fine of Rp 5 billion, a subsidiary of 1 year in prison,” said the prosecutor.

Benny Tjokro also required to pay replacement money of Rp 6,078,500,000,000.

Benny is believed by the prosecutor to have violated Article 2 Paragraph 1 in conjunction with Article 18 paragraph (1) letter b, paragraph (2) and paragraph (3) of Law No. 31 of 1999 concerning Eradication of Corruption Crimes as amended by Law No. 20 of 2001 concerning amendments to Law No. 31 of 1999 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.

The prosecutor revealed that Benny Tjokro and Heru Hidayat were working together in this corruption. The prosecutor said that Benny and Heru were proven to have collaborated in controlling the shares in an unnatural way.

“The defendant Heru Hidayat and Benny Tjokro made an agreement by selling and buying shares to increase the price of certain shares such as SMRU, IKP, Tram, MRYX by controlling shares controlled by the people of Heru Hidayat and Benny Tjokro so that the share price increased as if according to demand. “Reasonable shares, even though it is regulated by certain parties. After the shares rose unnaturally, then Benny Tjokro and Heru Hidayat sold the shares to PT AJS (Asuransi Jiwasraya),” explained the prosecutor.

In this case, the prosecutor said that the state lost Rp. 16 trillion on the control of shares by Benny Tjokro et al and three former Jiwasraya officials.

“So that it was found that state losses on stock investment amounted to Rp 4,650,283,375,000, and state losses on mutual fund investments amounting to Rp 12.157 trillion, so that the total state losses as a whole were 16,807,283,375,000.00 trillion,” said the prosecutor.

In addition, the prosecutor believes Benny Tjokro and Heru Hidayat are also proven to have committed the crime of money laundering (TPPU). The prosecutor believes Benny and Heru hid their assets by buying assets.

The money laundering that was carried out by both of them was disguised by buying land and buying and selling shares. This was done in collaboration with a number of parties.

“Therefore, we are of the opinion that the object of placing, transferring, transferring, spending, paying, granting, entrusting, taking abroad, changing forms, exchanging currency or securities or other has been proven,” said the prosecutor.

Therefore, Benny and Heru also violated Article 3 of Law No. 8/2010 concerning the Prevention and Eradication of the Crime of Money Laundering.
