Jhoni Allen Marbun sued the General Chairman Democratic party Agus Harimurti Yudhoyono (AHY) and a number of other parties because they did not accept being fired as cadres of the Democratic Party (PD) unilaterally. In his lawsuit, Jhoni sued AHY et al to pay Rp.55.8 billion. What is the reason?
Jhoni Allen’s lawyer, Slamet Hasan, explained why Jhoni asked for compensation when reading out Jhoni’s lawsuit at the inaugural hearing at the Central Jakarta District Court, Jalan Bungur Besar Raya, Central Jakarta, Wednesday (24/3/2021). Slamet said his client felt disadvantaged because he was fired unilaterally.
“Whereas the result of the illegal acts committed by the defendants resulted in material and immaterial losses suffered by the plaintiff,” said Slamet in the trial.
The details of Jhoni Allen’s losses are as follows:
Material loss
– The salary of members of the DPR RI is Rp. 60 million per month x 4 months = Rp. 2,640 billion
– DPR RI electoral visits amounting to Rp. 120 million per 6 months x 8 = Rp. 960 million
– Recess money Rp. 400 million per year x 4 = Rp. 1.6 billion.
– Aspiration house IDR 150 million per year x 4 = IDR 600 million.
The total material loss was IDR 5.8 billion.
Slamet also explained the immaterial losses that his client had sued. He said Jhoni Allen felt the SK dismissal was detrimental to his dignity. Jhoni also asked AHY to pay Rp. 50 billion to donate to social institutions.
“The immaterial losses suffered by the plaintiff were in the form of loss of dignity and loss of public trust due to the decisions made by the defendants. The immaterial losses amounted to Rp. 50 billion, which will be donated to social institutions in need,” he said.
