Through an information card, the SCJN reported that, in accordance with the procedures established by law and by agreement of September 5, 2023, the claim resources were transferred to the First Chamber of the Highest Court of the country, derived from the constitutional controversy 412/ 2023, presented by the government of Coahuila, headed by PRI member Miguel Ángel Riquelme.

The precautionary measure is requested to stop the printing and distribution of free textbooks that are not supported by current plans and programs.

The resolution last Friday and published this Monday highlights that while the authorities carry out the verification process, the SEP books delivered last school year may be used.

It indicated that the complaining party alleges that the claimed acts affect the protected rights contemplated by its corporate purpose, since the failure by the authorities with respect to obligations in educational matters affects the right to education with respect to which it has a special position. .

Since the corporate purpose is to verify compliance with that right, among others.

This is because the new free textbooks were not issued in accordance with previously authorized guidelines.

Therefore, it is considered that, at least in an indicative manner, the complainant proves the suspension interest, as there is a differentiated grievance regarding the corporate purpose and the allegation of the rights disputed in the lawsuit.
