Industry attacked by fireworks ban, considering lawsuit

The fireworks industry is considering legal action against the government because of the ban on bang fireworks and flares. That is what Marcel Teunissen of the Dutch Association of Pyrotechnics in The Hague says NOS Radio1 Journal. “The ban was not yet in place at the end of December, and now, when we cannot do anything with it, it is being implemented. We do not think this is proper”.

According to Teunissen there are about 10 million euros in fireworks in sheds, stores and at importers. According to him, that cannot be sold now. “And more things are added. Flares are also in packages, they have to be removed and the packages have to be put together again. Then you also get the drain and destruction, that is now being stepped over.”

Entrepreneurial risk

The fireworks industry wants to be compensated for this, but Minister van Veldhoven (Environment) said yesterday that she finds compensation “not logical, because it is still early in the year and the discussion about the fireworks ban has been going on for a long time”. And according to Prime Minister Rutte this falls under the entrepreneurial risk: “The risk is that the rules can change.”

Teunissen calls that comment “easily from the mouth of someone who is not an entrepreneur himself. We support the intention for this ban. But from one day to the next it is simply said” yes, a pity then. ” to get rid of.”

The industry had hoped that the sale of bangers and flares would be allowed for another year, just as happened with the category F3, the heaviest consumer fireworks, which was banned last year.
