The draft modification of the Customs Code establishes the possibility of other means of marketing the merchandise to be auctioned, by the National Customs Directorate (DNA), as stated by the control entity.

The changes to be introduced to the customs regulations, among other points, include the provisions currently in force for the commercialization of general merchandise and special merchandise (perishable, flammable, corrosive and similar).
According to the report submitted by the control entity, it is provided that in an emergency or catastrophe situation, the National Customs Directorate may authorize the donation of abandoned or confiscated merchandise, with the authorization of the competent bodies.

In addition, the National Customs Directorate may dispose of the goods that have been confiscated for their incorporation into its institutional patrimony.
Another point of the reform includes the chapter on customs control over international traffic, in that sense the DNA indicates that the use of computerized tools is emphasized for the record of loads that enter or leave the customs territory, which allow the immediate processing of data.
The figure of the electronic seal and technological measures as a security measure for customs traffic, the collection of fees for the customs services provided is guaranteed.
Likewise, the scope of the economic restrictions only on definitive imports and exports is updated, and greater responsibility is given to the declaring user regarding the data contained in the information provided to Customs.
Customs regimes
Regarding customs regimes, they are reorganized into import and export regimes, and are subdivided into definitive, suspensive and special.
In addition, emphasis is placed on the use of computer systems for the declaration of the different customs regimes and the forecast of the perception of export taxes in the event that they are incorporated in the future.

The DNA signals that the figure of the advance dispatch before the arrival of the means of transport, and electronically as established in the “Trade Facilitation Agreement”.
It also establishes the cancellation or rectification of the detailed declaration that may be made up to before acceptance by the customs authority or any inspection procedure, among others.
The bill is in the process of consolidation, after having been socialized and discussed with various sectors that are part of international trade.
The idea handled is present the project to Congress in August, in order to start the study for its approval and its entry into force from January 1, 2022, although the latest statements made by the national director of Customs, Julio Fernández, indicate that they could not finish the project for the next month.
