Government’s Chaotic Stand on Democratic Party: Faldo Maldini Speaks Out

Special Staff to the Minister of State Secretary Faldo Maldini said the government had behaved in a chaotic manner regarding the Party Democrats.

He emphasized that the government had refused to authorize the leadership of the Democratic Party’s stronghold of the President’s Chief of Staff Moeldoko Deli Serdang KLB version.

“If we trace it, actually the government’s stance through the Menkumham has already come out. That yes what Mr. Moeldoko is suing was issued by the Menkumham. So the government’s stance, yesAlready no,” Faldo said on the show Political Show Of CNN Indonesia TV, Monday (5/6) evening.

Regarding Moeldoko’s move to submit a Judicial Review (PK) to the Supreme Court (MA), he said it was his right as a citizen.

“But he, Pak KSP Moeldoko, took the legal steps. It’s impossible to intervene. He also has the right to question that, that’s his right,” he said.

On that occasion, Faldo also responded to a request from the Democratic Party led by Agus Harimurti Yudhoyono (AHY) who asked President Jokowi to replace Moeldoko because he was involved in the party takeover.

According to Faldo, Jokowi is the person who best knows the team’s needs to help him. Reshuffle, he said, was also Jokowi’s prerogative as president.

“The president knows his team best, to face the challenges, so once again, that’s the president’s prerogative, in which case we think the president won’t intervene to intervene in law and so on,” he said.

The attempt to take over the leadership of the Democratic Party which involved Moeldoko began with a press conference held by Democratic General Chair Agus Harimurti Yudhoyono (AHY) on 1 February 2021.

After that, an Extraordinary Congress (KLB) was held in Deli Serdang and appointed Moeldoko as General Chair on March 5, 2021.

Responding to the results of the KLB, Minister of Law and Human Rights Yasonna H Laoly announced that the government had rejected the request for ratification of the management of the Democratic Party for the Deli Serdang KLB version at the end of March 2021.

Yasonna said that from the verification results, there were several documents that had not been completed, including from representatives of the DPD, DPC and the absence of a mandate from the Chair of the DPD and DPC.

After that, various lawsuits and legal efforts were filed by the Moeldoko camp to obtain legality. However, the court repeatedly refused.

Moeldoko had sued the Menkumham to the Jakarta Administrative Court in relation to the refusal to ratify the change in the Democratic Party DPP management structure for the 2020-2025 term and the ratification of the Democratic Party’s Statutes/Bylaws (AD/ART). However, the lawsuit foundered.

The Administrative Court reasoned that it did not have the authority to adjudicate cases involving internal political parties.

Moeldoko’s legal efforts also ran aground at the TUN High Court and the Supreme Court (MA) until finally Moeldoko submitted a PK.

PK’s application has been entered and is still in the process of being tried by the Supreme Court
