Goo Hara’s mother appeared after the death… Law “Give 60% of your fortune to your father”

The court judged that more than his mother had to be given to his father and brother Gu Ho-in, who raised the wealth left by the late singer Goo Hara. Gu Ho-in and Goo Hara’s father have insisted that they are not eligible for property inheritance, saying, “When Goo Hara left the house when she was 9 years old and had not been contacted for nearly 20 years, she came to visit during the funeral.”

– According to law enforcement officials on the 21st, the second division of the Gwangju Family Court (Presiding Judge Nam Hae-gwang) said in a lawsuit filed by Gu Ho-in, a surviving family member against his mother, for a trial for the division of inherited property, “The contribution of Goo Hara to the surviving family is set at 20%.” Ruled. Accordingly, Goo Hara’s father and aid-in-law, a surviving family member, will receive 20% of Goo Hara’s property first, and the remaining 80% will be divided into half with his mother. Goo Hara Father and brother share 60% of the total wealth, and birth mother 40%.

The judge said, “Goo Hara’s father raised him alone for about 12 years without the help of the other (mother). “My father specifically supported Goo Hara so that it was necessary to adjust the claimant’s inheritance in order to promote real fairness among co-heirs.” The court said ▶Even though the parents had a divorce, the parents had not fulfilled their duty of support for 12 years, even though they had a shared responsibility to raise their children.▶The mother did not try to meet Goo Hara at all, even though the father did not interfere with the other party ▶ In the meantime, the fact that his father has actually supported Goo Hara was considered comprehensively.

Goo-hara passed away in November of last year. Goo Hara’s father transferred his inheritance to his brother, Gu Ho-in, and in the process, his mother also demanded an inheritance, leading to controversy over the division of property.

Attorney Noh Jong-eon (law firm S), the legal representative of Mr. Gu Ho-in, said, “The judgment of the court that acknowledged the contribution under the current legal system, taking into account all circumstances, etc., is a step forward from the standpoint of the existing court under the current legal system where the Goo Hara Act has not yet been passed. One judgment” he explained.

Roh said, “Even if we respect the court’s circumstances as much as possible, it is practically impossible to lose the right to complete inheritance to parents who have abandoned their children unless the Goo Hara Act is revised. In that respect, it is imperative to pass the Act.” .

The key point of the Goo Hara Act is to widen the scope of the law so that those who neglect the role of parents or children will not receive an inheritance. Article 1004 of the current Civil Code is recognized as a reason for disqualification of inheritance only in limited cases, such as murdering a family member or forging a will, and adding “a person who has remarkably neglected the obligation to protect or support the immediate existence or profanity”. Just do it.
