Ingrid van Kranen from Vught is one blind transgender who wants to be able to shop as independently as possible. A little help was needed, but Kruidvat staff refused to take her by the arm and show her around, because they found her “unsanitary”. And that is discrimination, non-pecuniary damage to 5,000 euros as a result. However, the judge thought otherwise!
Complaint
We are increasingly inclined towards American conditions in this country: “If I don’t like something, I’ll sue you.” Ingrid wanted to shop but the staff found her apparently gross and dared her not to tell. She wanted to walk along the shelves and touch dishwashing brushes, to feel if they met her wishes. Staff in the years before apparently found this never to be a problem and the staff of that day did, so the only explanation of course was discrimination. The staff would have been rude, even offering to put all items on a shopping list in a box, so that they could find out / feel everything themselves.
Discrimination!
Well, of course, because how dare you come up with a reasonable solution for someone who is less independent because of blindness, but who really wants to be independent? Anti-discrimination agency Radar was called and then even the College of Human Rights was called in, and they concluded: discrimination!
Don’t cry like that
The magistrate, however, did not participate in this whole jankcircus and did it just normal. 5000 euros compensation which they could write on her stomach. And its requirement for a weekly personal attendant while shopping at the Kruidvat they either got. The judge found her a big instigator and said that she felt “wrongfully intimidated”. Kruidvat, however, had to pay 600 euros in legal costs, because they should have been clearer at the time about why they did not want to engage her.
