German Court Orders Astrazeneca to Reveal Thrombosis Data in Vaccine Lawsuit

In one of the first civil proceedings against one of the coronavirus vaccine manufacturers in Germany, the plaintiff has achieved partial success before the Higher Regional Court (OLG) in Bamberg. Astrazeneca, the company sued for side effects caused by its vaccines, has been forced to reveal all data on cases of thrombosis suffered by people who were vaccinated with its product.

This same measure could be applied by other courts, in the hundreds of cases pending in Germany due to the side effects of vaccines, which affect all manufacturing companies and which can lead to multimillion-dollar compensation. In this case, the plaintiff demands 250,000 euros in compensation, 17,200 euros for lost profits and up to 600,000 euros for future damages. This is a 33-year-old woman from Hof, who suffered a thrombosis of the intestinal veins after being vaccinated with the Cov-19 vaccine “Vaxzevria”, she fell into a coma and is still suffering from the consequences today. She is suing the manufacturer Astrazeneca in the second instance. At the moment she has managed to get Astrazeneca to provide all the information related to the clinical picture of thrombosis associated with its vaccine.

In the partial ruling, the court determines that the manufacturer must provide data on thrombosis and all other findings that could be important “for the evaluation of the acceptability of the harmful effects” of the vaccine, insofar as they relate to the so-called thrombosis syndrome with thrombocytopenia, in the period between December 27, 2020 and February 19, 2024. The order could be extended to all effects and side effects of the vaccine.

In principle, the court considers that the vaccine is capable of causing thrombosis and Astrazeneca must submit a comprehensive statement. Once the information is available, the court can appoint an expert. The plaintiff’s lawyer hopes that an expert opinion will be available by the end of the year. According to the lawyer, “it could take years before a final verdict is reached, but it will still be worth it.” So far, the defense has ruled out a deal.

Since vaccination against the coronavirus began, 2,712 requests for recognition of damages due to vaccination have been filed and to date more than 2,000 requests have been processed and damages have been recognized in 140 cases. The release of side effect data could tip the balance in many pending cases and even lead to more lawsuits being filed.
