WIESBADEN – “Inheritance law is always individual. It is always important to relate individual cases to inheritance law, ”explains lawyer Martin Hackenberg. He and four other colleagues as well as the head of asset succession planning at Wiesbadener Volksbank will now offer free initial advice on wills, inheritance law and foundations on Thursday, November 19, on the expert hotline of the Wiesbaden Foundation, which is supported by Wiesbadener Kurier and Wiesbadener Volksbank. Each caller has 20 to 25 minutes to either classify the matter or, in the case of simple questions, to deal with it finally.

The latter could be the case, for example, with questions of form. Because a will is only effective if it is completely handwritten and provided with the place of the constitution, date and signature or if it has been certified by a notary. “The notarization by a notary has the advantage that the heirs do not need a certificate of inheritance to legitimize themselves,” explains Hackenberg. In addition, the will is automatically deposited with the district court in this case. The testator can also do this personally and thus ensure that his last will is found when it is needed.

Another classic case is dealing with the compulsory portion right. “Many are relatively determined who should inherit them. But you can’t just withdraw compulsory portions like that. The point here is to clarify the limits of what is imagined, ”explains Hackenberg. The descendants of the testator as well as his or her spouse and parents are entitled to compulsory portions if they are still alive at the time the will is opened. The entitlement can only be withdrawn in exceptional cases. The lawyers and notaries Boris Kiedrowicz and Holger Poth as well as their retired colleague Peter Schirmer are available to answer questions on the expert telephone. The campaign is organized by the Wiesbaden Foundation, of which Hackenberg is a board member.
