People have been living in retirement and nursing homes for over two months because of the coronavirus pandemic. For Thomas Manhart an unsustainable condition. “As a former top prison chief, I know a lot about locking people in,” he writes in a comment for the “Daily scoreboard”. The same applies to residents at the moment.

Manhart’s mother lives in a home. His disabled son too. The 91-year-old suffered particularly from the separation from her relatives. “The meanwhile permitted visit behind cutting discs and the recent exit option that is permitted under many conditions is a weak consolation,” writes Manhart.

For Manhart, what is currently being done with the old and disabled people is deprivation of liberty and coercion. «Of course people will hold me up, there are legal justifications for that. But this reason is not enough, »said the 63-year-old.

Criticism of the federal government and the cantons
Manhart does not want to criticize those responsible for the home and caregivers, but the people responsible for it at the highest cantonal and federal levels. “Measures restricting freedom must always be proportionate and appropriate.” Neither is there anymore.

Manhart’s main criticism: “The strong restrictions in personal freedom are still valid indefinitely.” The Zurich SVP cantonal councilor Maria Rita Marty also wants to abolish the visiting rules in the homes as quickly as possible.

Appropriateness of the measures should be checked regularly
According to the lawyer, the measures should be checked for their appropriateness at regular intervals. From a legal point of view, it is also questionable for Manhart if individual protection of fundamental rights is restricted for so long by “mere administrative orders”. The elderly and disabled have no strong lobby that works for them.

Bringing the relatives out of the homes is also not an option for Manhart: “Anyone who argues that must be countered that today most families rely on the fact that they are very elderly parents or disabled people with a certain degree of care can accommodate in homes. »
