“It’s still crazy, the steps to take for people to leave your home!” Pierre Loreto does not hide his annoyance. Since October 2, about fifteen caravans have occupied the land of approximately 25 acres which it owns in Cosnes-et-Romain.

A question of procedure

Since then, Pierre Loreto has taken the necessary steps to put an end to this illegal occupation. Starting with the observation of a bailiff, on October 5. “On the 9th, the president of the judicial tribunal of Val de Briey signed an expulsion order. The bailiff presented it to the occupants on October 13, telling them that they had 24 hours to leave, ”says Pierre Loreto. “They were still there on October 15th. So the bailiff approached the prefecture to request recourse to the police, ”concludes Cédric Aceti.

In Nancy, the prefecture confirms the chronology. But his services provide a clarification: “In matters of private land, the procedure must first go through the judicial court before the prefecture is requested for an eviction. This is the difference with the public domain. Hence the delay, in the case of Cosnes-et-Romain.

Imminent eviction

“We are still waiting for the prefect to bring in the police,” summed up Jean Huard, vice-president of the Longwy agglomeration community (CAL) on Monday evening. Even though the property is private, CAL is affected by the case, as it carries the Travelers jurisdiction. “An inter-municipal decree forbids them to settle outside the reception areas, in Mont-Saint-Martin and Longwy-Longlaville, and that of large passage, in Lexy. “Today, Jean Huard makes the particular case of Cosnes-et-Romain an inter-municipal school case …” Systematically, in the hours following an illegal installation, we seize the prefecture. We must be one of the few urban communities in order with the departmental plan for welcoming travelers. And yet, our requests never succeed… ”

In this case, however, it seems that things have accelerated since Monday, when the prefecture of Meurthe-et-Moselle received the request of the bailiff in charge of the case. This Tuesday afternoon, the state services let it be known that the prefect had given his agreement for an eviction. “Generally, this occurs within 48 to 72 hours”, we explained to Nancy. At around 4:30 p.m., two gendarme patrols arrived at the camp, which they left an hour later. The evacuation appears imminent.
