The event started on a Saturday evening at the end of August 2019. According to the indictment, a 21-year-old geriatric nurse and an acquaintance of about the same age came to a retirement home in the Tirschenreuth district to visit a 20-year-old friend who was on the night shift. During a tour of the house, the trio targeted a 90-year-old woman with dementia.
The 21-year-old smeared her thickly with face cream, sprayed her hairspray in her mouth and suppressed the senior citizen’s urge to cough with a pillow. His colleague is said to have stood by the whole time. The mood was exuberant, just not with the young lady, who just wanted to sit next to nothing. The victim survived the ordeal unscathed. The fact that she died a few weeks ago has nothing to do with the fact.
Rapid wheelchair rally
In the next room, the 21-year-old let a confused senior citizen smell her covered diaper and insulted her. A fast wheelchair rally in the corridor was just as much a part of the trio’s “fun evening” as eating a round of cake in the lounge.
In addition, prosecutor Matthias Biehler accused the 20-year-old person on duty of “violating the very personal sphere of life”. He had hacked the companion’s smartphone to monitor her WhatsApp correspondence. He also took photos several times without the residents’ consent and sent them digitally. There was also a secret love game by an elderly couple.
Several of the two defendants’ colleagues testified that they had nothing to complain about in the work, behavior or collegiality of the two male trainees. The district youth welfare office attested that the 20-year-old, who was on sick leave after the most recent of several suicide attempts, had a difficult time in life. The family circumstances are difficult, the mountain of debt has now piled up to 20,000 euros. The 21-year-old main offender, on the other hand, is socially classified and well integrated into the family.
After taking evidence, the prosecutor saw the allegations confirmed. The 21-year-old confessed and showed remorse. Nevertheless, a youth sentence of one year and nine months and a monetary requirement of 3000 euros are announced. He bears a grave guilt. Because of the insight shown, the prison sentence could be suspended to three years. The prosecutor demanded the same sentence for the second defendant. Because he found it much more difficult to repent and understand, there could be no probation here.
Money to Stiftland workshops
Marc Steinsdörfer, defender of the 20-year-old, saw a monetary requirement for smartphone hacking and the illegal sending of private pictures as sufficient. Attorney Richard Duchek requested a youth sentence of less than a year and a monetary condition. His client had confessed and apologized. The juvenile lay judge left it for both defendants at one year juvenile detention and set the probation period for three years – two of them under the supervision of a probation officer. 3000 euros each go to the Stiftland workshop in Mitterteich.
