The Supreme Court does not deal with the guilt issue. If the Supreme Court grants Jensen legal recourse or legal action, the judgment may be set aside, and thus the case will have to be re-examined by the Borgarting Court of Appeal.
“It is contended that Jensen must be acquitted by the Supreme Court by the proper law regarding the record I of the appeal and that the record II must be repealed,” writes defense attorney John Christian Elden in the appeal that was sent Friday, the same day the appeal deadline expired. .
Elden has listed in the appeal nine examples of what he believes are procedural errors, including that the district court judgment was handed out to the judges before the appeal hearing, and lack of specification of what Jensen was convicted of.
Elden writes to NRK that he must send a letter of appeal in September.
Eirik Jensen was sentenced to 21 years in prison in Borgarting Court of Appeal on June 19, for contributing to the importation of 13.8 tonnes of hashish and gross corruption.
