Donald Trump Appeals to US Supreme Court for Immunity in Election Interference Case

Feb 12, 2024 at 11:25 PM Update: an hour ago

Donald Trump is asking the US Supreme Court to suspend its decision that he does not have presidential immunity and can be prosecuted for influencing the 2020 election. Several report this American media.

Trump’s lawyers are asking the Supreme Court to “pause” the federal court’s ruling in the District of Columbia. In the meantime, Trump could challenge the court’s ruling, possibly also before the Supreme Court.

Last Tuesday, the federal court in the District of Columbia ruled that Trump does not have presidential immunity and can be prosecuted for his interference in the 2020 presidential election and the January 6, 2021 Capitol storming.

Trump previously stated that he cannot be prosecuted in that case because the allegations relate to the period when he was president. According to the judge in the District of Columbia, that immunity has lapsed.

“In this case, former President Trump has become citizen Trump,” the court wrote. “The immunity that would have protected him when he was president no longer protects him from prosecution.”

A lower American court had made the same ruling in December. Trump appealed to the federal court.

Trump leans on Supreme Court

Now Trump decides to go to the US Supreme Court to “pause” the ruling. The Supreme Court contains the nine highest judges in the country. Six of them are conservative and three are progressive. Three of the conservative judges were appointed by Trump himself.

The case against Trump, in which he is accused of obstructing the outcome of the 2020 presidential election and his role in the storming of the Capitol, is scheduled to begin on March 4. But the judge hearing the case recently postponed the case indefinitely.

If Trump is found guilty, he will likely be barred from running for office in the 2024 presidential election. But if the case is postponed until after the presidential election, Trump could suspend investigations into him if he becomes president.
