Deputy attacks against requiring a license in shops: “Vaccination must be a free act and never mandatory”

The deputy of the Christian Social Unity (PUSC), Shirley Díaz Mejías, attacked this Tuesday in the Legislative Plenary against the possibility that the vaccination card will be required in the future as a requirement for people to enter businesses and restaurants in the country.

This measure, that has already been implemented in nations such as France, began to resonate since last week, after the President of the Republic, Carlos Alvarado Quesada, It should be noted that the health authorities will evaluate adjustments in the restriction measures in force in the country, such as the presentation of a card that certifies vaccination against COVID-19 in the future.

The authorities, however, have been emphatic that this measure would be taken later, when most of the population is immunized against the SARS-CoV-2 coronavirus.

However, and as Díaz pointed out this afternoon, “Vaccination must be a free act and never compulsory”, so he asked his fellow legislators to pay “a lot of attention” to this proposal.

As stated:

The vaccine against COVID-19 is necessary to return to normal activity but be careful, it is an act that must be free and voluntary, never forced and Nor should any vaccination card be required to enter shops. I want to make this warning because last week President Alvarado said that an issue to be evaluated for the opening of shops was the use of the vaccination card to enter them. Be very careful, colleagues, citizens should not be required to demonstrate that they have already received at least one dose of the COVID vaccine to enter restaurants. What do they want with this in the middle of such a slow vaccination process? Finish shutting down the economy? This measure cannot be applied either, even with the number of doses for the entire population. I believe that vaccination is opportune, but this is in accordance with our laws and in accordance with the rule of law, that is why vaccination should be a free act and never anything obligatory. “

The Social Christian legislator assured that a measure of this type “It could give rise to ideas that could strengthen the mandatory vaccination in the future”, a possibility that was stated against stating that:

It is unconstitutional and violates the rights of citizens. It would not be the first time that the Executive Branch has applied bullying. We have seen it in the demonstrations with the force used by the police and also in the decrees such as the UPAD and of course, the technical norm in favor of abortion. We must be vigilant to stop these dictatorial ideas that have been the daily bread with this PAC government and that with the excuse of the pandemic they have come to violate the rights of Costa Ricans. “

The issue of mandatory vaccination against COVID-19 has been in the fore for a long time and in this regard, instances such as the Constitutional Chamber and the Administrative Disput Court.

According to the records of the Judicial Branch, to date, More than 15 appeals and appeals to appeals that oppose the mandatory nature of the vaccine have been rejected in scenarios such as the delivery of health services.

In them, the appellants have presented allegations such as the one that requested the prior signing of informed consent before the person was vaccinated; the one that asked for the acceptance of conscientious objection in case the person did not want to receive the vaccine; or another that points out that the vaccine was an “experimental treatment” and that is why he asked not to receive the immunization.
