Covid: gyms, travel and concerts – refund or voucher? After discussions that have engaged our Government for the duration of the lock down, the Relaunch Decree clarified any doubts.

The Relaunch Decree provides for the customer’s right to a voucher, to be used in the following 18 months. It can be used for that same show if scheduled again.
Otherwise, the voucher can be used to purchase a ticket for another show.
And never mind if the spectator had chosen that particular show because for him it was the absolute favorite.
If the show or concert is rescheduled for another date, the ticket will remain valid.
If the spectator is busy on the day of the new program, he can only ask for a voucher. He will not be able to ask for a refund because the show was there, it was organized again.

The Aduc Consumers’ Association claims no.
Italy is behaving differently from other European countries, where a refund is made, returning the money to the spectator.
This is what European Union law provides. For example, the European directives on unfair clauses (Directive 93/13 / EEC) and unfair commercial practices (Directive 2005/29 / EC).

For gyms, everything we have said above applies. The manager can choose whether to offer you a refund or a voucher to use within one year.
With one more element, however.
The customer may no longer feel like going to that gym in the future.
How to get reimbursement for the gym?
In this case, we suggest sending a registered letter to the gym with which to request reimbursement for the closing months for Covid. Also ask for a refund of the remaining months until the subscription expires.
The norm to be mentioned, this time, is art. 1463 of the Civil Code, on the termination of the contract.
If the gym does not respond to you within 15 days, all that remains is to appeal to the Justice of the Peace.
