Covid-19: the Constitutional Council validates the new health law

Seized by deputies rebellious Francethe Constitutional Council gave the green light this Saturday, July 30, 2022, to the provisions concerning the Overseas Territories in the new health law in the face of Covid, after a referral from LFI deputies.

Definitively adopted by Parliament on Tuesday, this new piece of legislation allows possible health checks at borders – a negative Covid screening test – in the event of the appearance of a new particularly dangerous variant.

End of the health pass

An identical system may apply for trips from France to overseas communities, for example, “in case of risk of saturation” of their health system. The LFI deputies had announced an appeal concerning the overseas territories, considering that they were the subject of a difference in treatment “unjustified”.

However, the Constitutional Council ruled that the impugned provisions were constitutional. “The principle of equality does not preclude the legislator from regulating different situations differently, nor from derogating from equality for reasons of general interest, provided that, in one and in the other case, the resulting difference in treatment is directly related to the object of the law which establishes it”, he points out.

This law also explicitly puts an end to the 1is August 2022 to the health pass and other exceptional measures against Covid-19.
