Controversial GoFundMe Campaign for Police Officer’s Family Raises 1.6 Million Euros

The creation of this kitty, launched by the far-right polemicist Jean Messiha, had been strongly criticized, some arguing that it legitimized police violence. Nahel’s family had filed a complaint and LFI deputies had seized the public prosecutor to close the kitty.

Funds “for the sole purpose of providing for the needs of the family”

One of the arguments put forward is Article 40 of the Freedom of the Press Act 1881, which prohibits in France “opening or publicly announcing subscriptions for the purpose of compensating fines, costs and damages pronounced by judicial convictions”. According to critics of the kitty, the amount paid could be embezzled and used to pay the police officer’s legal costs, which would be illegal.

But the beneficiary of the campaign “has undertaken in writing that all the funds raised will be used in accordance with the objective of fundraising, that is to say for the sole purpose of meeting the needs of the family,” explains GoFundme, “she has pledged that none of the funds raised will be used in any way to defend her husband or to compensate for any convictions that may be handed down in court. against her husband following the events that occurred in Nanterre and in connection with Mr. Nahel Merzouk. »

The policeman’s wife should return the funds collected that would have been used for another purpose, writes the platform, “and answer for all the legal consequences resulting from non-compliance with her commitments set out above. »

The case still not closed

GoFundme does not specify when the money was paid to the beneficiary, or whether it was subject to taxation. However, it is possible that the amount of 1.6 million euros will be amputated by the tax authorities, several tax lawyers had indeed explained to the Parisian that this kitty was in theory taxable at 60%.

On the other hand, the legal proceedings launched against this kitty could lead to the cancellation of the collection in the coming months. The lawyers interviewed had pointed out that, in this case, the beneficiary could be asked to return the money received to the donors.
