A 25-year-old construction worker kicked his 4-year-old stepson on the back of the head twice at Wong Tai Sin’s residence, causing him to fall to the ground in July this year, because his 4-year-old stepson refused to eat. The construction worker involved in the case had previously pleaded guilty to one charge of assaulting a child or minor in his custody, and was sentenced to 12 weeks in jail by the Kowloon City Court yesterday (28).
The 25-year-old defendant, CWK, reported that he was a construction worker and was accused of taking 4-year-old boy X into custody on July 20, 2022 at a unit in Tsz Ching village, Tsz Wan Shan Road, Wong Tai Sin. or a person with a duty of care, intentionally assaulted Boy X in a manner that could cause unnecessary suffering to Boy X.
The facts of the case stated that the defendant married the biological mother of 4-year-old boy X in 2019. At around 6:00 pm on the day of the incident, X was sitting in a chair in the living room. The defendant kicked X in the back of the neck, causing X to slam into the table in front of him. X immediately covered his face with his hands and cried. The defendant kicked X again, knocking X to the ground, the defendant kicked the chair again and the chair hit X on the head. There was closed circuit television in the house where the crime took place. Upon learning of this, the defendant’s wife sent the footage by email to Po Leung Kuk’s staff. Subsequently, the staff called the police. The police found no superficial injuries on X’s body. The defendant, under admonition, said he kicked X because he didn’t want to eat.
