Coca-Cola Femsa requests protection against new labeling

Coca-Cola Femsa awaits the resolution of an amparo against the labeling law enacted in March 2020 and warns that this reform could have an impact on its business in the country.

“The Company has filed an amparo lawsuit against this reform, which is pending resolution. The Company cannot assure that this reform will not have an adverse effect on its business and the results of its operations in Mexico, ”the firm told the Mexican stock exchange.

Coca-Cola explained that the new labeling law establishes that as of October 1, 2020, the entire portfolio of the company, except water, must comply with these new labeling guidelines, the foregoing even though the Products labeled in compliance with the above NAME-051 may remain on the market until November 30, 2020.

The company recalled that it also filed another amparo against the Law for the Prevention and Comprehensive Management of Solid Waste, published in June 2019 in Oaxaca, to prohibit the use, sale and distribution of single-use PET resin bottles for water bottles and any other beverage in said entity.

“As a result, on July 30, 2019, two of the Company’s Mexican subsidiaries filed an amparo lawsuit against this reform and requested a provisional suspension, which was denied. This process continues and is pending resolution. The company cannot assure that the legal actions it takes will have the desired effect, or that the reform will not have a material impact on its business and the results of its operations in Mexico, ”the company said.

New labeling

This new labeling reached the packaging of foods with the highest caloric, sugar, fat and sodium content.

Currently, there are several pre-packaged foods and beverages that bring and comply with the new labeling, which will be mandatory from October 1, although there will be no sanctions for those who fail to comply between now and November 30, that is, there are 60 days of Grace.

This must be accomplished under the Official Mexican Standard 51 Food NOM-051-SCFI / SSA-2010, which requires general labeling specifications for prepackaged food and non-alcoholic beverages, commercial and health information in which it is requested to alert the consumer with black seals in the form of octagons about the content in excess of sugars, fat, sodium, calories, and saturated fat.
