China-U.S. WTO semiconductor litigation battle begins, Taiwan is allowed to sit in on Russia but rejected- Cross-Strait- China Times News

China’s trade lawsuit at the World Trade Organization (WTO) against U.S. restrictions on semiconductor exports is about to start. During the litigation negotiation process, Taiwan and Russia successively applied to join the hearing as third parties with interests, but the United States only agreed to Taiwan’s participation, and Russia’s application was rejected.

According to “Core Intelligence News”, the United States has continuously introduced a series of policies since 2018 to restrict the export of many semiconductor products to mainland China, and has included many Chinese technology companies in the entity list. In particular, after the United States introduced a semiconductor export control policy against China in October last year, the Chinese Ministry of Commerce filed a trade lawsuit against the United States at the WTO in December last year.

The Ministry of Commerce of China stated in a statement that the United States has continuously generalized the concept of national security in recent years, abused export control measures, hindered the normal international trade of chips and other products, threatened the stability of the global industrial chain and supply chain, disrupted the international economic and trade order, and violated international economic and trade rules. It is a typical practice of trade protectionism to violate the basic economic laws and harm the interests of global peace and development. China’s filing of a lawsuit at the WTO is to resolve China’s concerns through legal means and is a necessary way to defend its legitimate rights and interests.

According to two documents released by the WTO today, the United States rejected Russia’s application on February 9 on the grounds that Russia had premeditated and unprovoked invasion of Ukraine, and therefore had no willingness to engage in normal business-as-usual conduct with Russian representatives.

The United States stated that Russia’s reason for applying to participate in the audit is completely untenable, because Moscow has stated that the United States’ ban on China’s import of high-end semiconductor products will damage Russia’s substantial interests.

Another document pointed out that the United States agrees that Taiwan is a third party of interest, and pointed out that in 2021 Taiwan will account for 26% of the global semiconductor industry revenue, and has close bilateral trade with the United States. The reasons for participating in the audit are quite similar. full.

The report said that in previous WTO disputes, it was quite rare for multiple parties to apply for hearings, some of which were accepted and some were rejected. According to the provisions of the WTO dispute settlement mechanism, during the negotiation stage, China cannot change the situation that Russia was refused to participate in the hearing. Neither the United States nor China has the right to refuse participation as a third party.
