BPK Angry, Accused of Protecting the Bakrie Group in Jiwasraya

Jakarta, CNBC Indonesia – The Supreme Audit Agency (BPK) did not accept the accusation of one of the suspects in the PT Asuransi Jiwasraya (Persero) case, Benny Tjokrosaputro or familiarly called Bentjok, protecting the Bakrie Group in the case. The BPK held a press conference today to present the latest developments in the Calculation of State Losses (PKN) in this case.

BPK Chairperson Agung Firman Sampurna stressed respecting the trial process of the Jiwasraya Insurance case which is still ongoing and is still being handled by law enforcement officials. Related to Bentjok’s statement, Firman stressed that the State Losses Calculation (PKN) issued by BPK was a support of the law enforcement process (pro justicia) carried out by law enforcement officials, in this case the Attorney General’s Office.

This is different from other types of BPK audits or audits, PKN is conducted on condition that law enforcement has entered the investigation stage.


In that stage, he said, the suspect had been determined by law enforcement officials, of course taking into account the adequacy of the evidence of the occurrence of a criminal act, in this case the criminal act of corruption (Corruption).

He explained, procedurally, after the suspects were established, law enforcement officials submitted to the BPK for PKN.

The next stage is the exposure or case title, in which information is presented by the investigator regarding the construction of unlawful acts that contain malicious intentions (mens rea).

The exposure was conveyed by law enforcement officers by providing sufficient preliminary evidence. From the exposure of the Jiwasraya case by the Attorney General’s Office, the BPK concluded that the construction of the act against the law was clear and had been supported by adequate initial evidence, and therefore the PKN could be carried out.

Of course, he said, PKN both in substance and procedure is part of the examination of the management and responsibility of state finances and is the authority of BPK. Thus PKN is carried out by applying extra stringent State Financial Inspection Standards (SPKN).

“With this framework, it would be funny to say that the BPK or the BPK Chairperson and Deputy Chairperson protect certain parties. Because the BPK counts PKN after the construction of unlawful acts and the suspect is determined by the Prosecutor’s Office,” Agung said in a press conference on Monday (6/29/2020 ).

Firman said, indeed there were no parties who were comfortable following the trial process until they were named as defendants.

“Especially if we are charged with law and must carry out all legal proceedings. We announce it also because of what the accusations conveyed [kepada BPK] which is unfounded. “We will officially report the illegal act committed by Benny Tjokro related to defamation of the Criminal Investigation Body of the Indonesian Police Headquarters,” said Agung.

Previously, on Wednesday last week (24/6), the owner of PT Hanson International Tbk (MYRX) Bentjok who was one of the defendants in the Jiwasraya case, gave a response regarding the rejection of an exception by the Corruption Court judges.

Before the trial, Bentjok, as he was usually called, gave a statement to the media crew. This corner, which was a suspect in the Jiwasraya case, accused BPK of covering up the Bakrie Group’s involvement in the Jiwasraya case.

“The BPK is covering up. The one covering the chairman and deputy chairman of the BPK, certainly the Bakrie crony. Indeed, the one covering it up. Indeed, the BPK Chairperson and Deputy Chairperson are covering it up,” explained Bentjok.

Bentjok hoped that all parties who investigated the Jiwasraya case would be open in the investigation. By opening this case, said Bentjok, the community could help and not appear to be covered up.

Until now, according to Bentjok, the Bakrie Group has not been examined because it is protected. But Bentjok did not clearly state who the intended party was to protect the Bakrie Group.

As is known, the AGO has set six suspects in the Jiwasraya mega scandal. The six suspects, namely Bentjok are Managing Director of Hanson International, Heru Hidayat (President Commissioner of PT Trada Alam Minera Tbk / TRAM), Hary Prasetyo who is the Jiwasraya Finance Director for the January 2013-2018 period, Hendrisman Rahim who is also the President Director of Jiwasraya for the 2008-2018 period, and Syahmirwan, former Head of Jiwasraya’s Investment and Finance Division.

Another one is PT Maxima Integra Director Joko Hartono Tirto. On Friday last week, added the suspects namely 13 investment manager companies and 1 senior Financial Services Authority (OJK).

Furthermore, BPK, emphasized, however, that it fully supports law enforcement carried out by the Prosecutor’s Office, both in the disclosure and trial of this case.

“Considering the large and massive case, together with the Prosecutor’s Office, we even had the chance to make the PKN formulation not only for the loss of the state, but also for the loss of the country’s economy. But after careful consideration of the juridical technical aspects, it was finally decided to remain a PKN,” Agung said.

On the other hand, he said, as we have often said, the BPK itself also carried out an investigative audit of the Jiwasraya case. The investigative audit process is still ongoing. The scope of the audit is broad-scale, and aims to uncover the construction of the case and the parties responsible fully, starting from the institutional Jiwasrayanya itself, the FSA, the stock exchange authority, the Ministry of SOEs, including SOEs associated with this case.

“The expected impact of this audit is systemic improvements that further protect customers from the risk of fraud and increase investor confidence in investing in Indonesia, particularly investments in financial services instruments and capital markets.”

“Once again it is emphasized here, that we highly respect the process of law enforcement, so that it will not enter into the substance that has now become the realm of the court. We understand, that no human being is comfortable being examined let alone having to deal with law enforcement officials, following the judicial process “Even more so if the status of the defendant,” said Agung.
