Beware of the new ticket for hazardous travel


The Ministry of the Interior and Administration introduced a new provision to the Code of Petty Offenses. It concerns a ticket for traveling in dangerous conditions. The change has already been approved by Prime Minister Mateusz Morawiecki.

The mandate tariff has been enriched with a new item, which has been in force since April 10, 2021. Officials decided to look at article 117, which was about keeping clean and tidy. Until now, it read: § 1. “Whoever, having the obligation to maintain cleanliness and order within the property, does not perform his duties or does not comply with the instructions and orders issued by the competent authorities in order to ensure the proper sanitary condition and fight infectious diseases, is subject to punishes a fine of up to PLN 1,500 or a reprimand ”.

Now a new sub-item has joined it. In art. 117 § 2 of the Code of Petty Offenses, point 16a states: “Failure by the carrier obliged to provide passengers with adequate hygiene conditions, the means of transport in a proper sanitary condition”. This means that for the lack of disinfectants or dirt in the vehicle or bus, the policeman may punish the driver with a fine of PLN 100-250. Failure to accept the ticket may end up with a request for punishment to the Sanepidu. In this case, the administrative penalty is from PLN 5,000 to PLN 30,000, which is the same as for the penalty for not covering the mouth and nose.

It is worth remembering that in your own car, motorcycle, quadricycle or moped you do not need to cover your mouth and nose. However, in the event of a police check, it must be done. The mask can be removed only at the request of the inspector, in order to verify the identity. It will also be useful in the event of a breakdown, when it is necessary, for example, to call roadside assistance, service visits or when replacing tires. Failure to comply with the requirements may result in a fine of up to PLN 500 (Art. 116 par. 1a). In a situation where people know that they have COVID-19 or are waiting for the test result and deliberately break the restrictions, they may be fined up to PLN 1,000. Refusal to accept a ticket means that the application is sent to the court (fine from PLN 5,000 to 30,000).
