At least half a million workers do not receive holiday pay: ‘Don’t just agree’

The CNV conducted a survey of 1,700 members and it shows that 8 percent will not receive holiday pay this year. About 11 percent do not yet know whether they will receive their holiday allowance. And that is bad, according to the union CNV.

“It is a legal right, an employer may not withhold this money just like that,” spokesman Jolanda van Zwieten told RTL Z. “It is only possible to cut or reduce holiday pay in consultation with the employee.”

Consequences for a benefit

If an employer asks you to waive your holiday pay, it is best to seek advice before signing for it. Van Zwieten: “Don’t just put your signature at the cross. If you opt out of your holiday allowance, this will also have consequences for your WW benefit.”

If you are fired or the company goes bankrupt, you can apply for a benefit from the UWV. The unemployment benefit is a percentage of the last-earned salary. Because holiday allowance is part of your salary, you will receive a lower unemployment benefit if you have had less holiday allowance.

Help from the union

The CNV opened a special hotline on Saturday. Whoever receives no or less holiday allowance can get help there. The union will then talk to the employer to find a solution. If an entrepreneur has no valid reason to withhold vacation pay, the union may even want to ‘move to firmer resources’, such as a lawsuit.

Especially SMEs

“We understand very well that entrepreneurs are in difficult times,” said the spokesman. “Of course you are financially hard if you do not make any turnover with your catering business at the same time. At the same time, the government generously welcomes entrepreneurs. So they do not have to pay the wages and holiday pay in full.”

The CNV investigation shows that it is mainly small and medium-sized companies that do not want to pay holiday pay. “We actually see it in all sectors, although it is a bit more common with technical companies,” says Van Zwieten.

Procrastinate or spread

There are also entrepreneurs who pay the holiday allowance later or in installments. “That is certainly a better option,” said the spokesperson for CNV. “Then employees will get their money later and it will have no consequences for any benefits.”
