ADAC: “Compensation acceptable”: consumer center accuses VW of fraud

The association is conducting the model declaratory action against an estimated 460,000 German VW customers. The negotiations between VW and the vzbv broke on Friday. The carmaker cited excessive fee claims by the vzbv litigants as a lump sum of 50 million euros. Volkswagen then announced that it would compensate the plaintiffs out of court in the model determination procedure. A total of 830 million euros would be available for this. Depending on the vehicle and vehicle age, VW wants to offer between 1350 and 6257 euros.

Müller warned VW customers in the “Handelsblatt” not to accept the new comparison offer. It was difficult for a single customer to understand whether VW was paying the right amount, he said. He also asked the car company to now compensate all diesel customers in Germany and not just the plaintiffs. “Volkswagen must now put up with the question of whether the group should not pay compensation to all affected diesel customers in Germany. Why not if Volkswagen is now taking its own proposal seriously?” Said the consumer advocate.

In contrast, the ADAC welcomed the offer of the car company to compensate customers. “The offer from VW is acceptable to the consumer and corresponds to the result of the settlement negotiations,” said the head of the automobile club, Markus Schäpe, the newspapers of the Funke media group. The vzbv and the ADAC had filed the model declaratory action against VW together. On behalf of the customers concerned, they went to the Higher Regional Court (OLG) in Braunschweig. They want to clarify there whether the car company has harmed diesel buyers “deliberately and immorally” and therefore has to pay compensation. Vzbv announced on Friday that it would continue to fight in court for a solution for consumers.
