MEXICO CITY (appro). – The Argentine actress of “Ugly Duckling”, Thelma Fardin, announced on Saturday May 13 that she will appeal the acquittal of actor Juan Darthés, issued by the Brazilian justice in the trial where he was accused of having raped her when she was 16 years old.
“Of course I’m tired, but they’re not going to break me and this doesn’t end here,” said the actress, who is currently 30 years old.
At a press conference in Buenos Aires, Argentina, together with his lawyers and the director of Amnesty International Argentina, Paola García Rey, he indicated that it was learned that Saturday that Darthés, who left for Brazil after receiving the complaint, had been acquitted in first instance in the trial held by the Brazilian court.
In 2018, Fardin accused him of having abused her in Nicaragua, in 2009, when she was 16 years old and he was 45, while they were promoting the series “Ugly Duckling”.
Fardin said the ruling mentioned that much of sexual abuse is proven.
“It is proven that he performed oral sex on me, it is proven that there was penetration with his fingers, but since it happened in 2009, it is prescribed. If it had happened in 2010, it would not be prescribed, ”she said and claimed that then it is necessary to say the moment when a woman is abused and that it is also proven that the sexual abuse was with carnal access.
Their lawyer Carla Junqueira said that they could appeal in a second and third instance and to international courts, although the crime happened in 2009, the Brazilian penal code required evidence of carnal access to characterize it as rape.
A 2010 reform stopped requiring penetration and carnal access to commit a crime of rape.
“The acquittal of Darthés does not mean that the event did not happen, but rather that the judge assessed that the evidence was not sufficient to convict him. Amnesty International will continue to call for justice so that sexual abuse does not go unpunished. #JusticeForThelma,” AI wrote on her social media.
Darthés denied the rape and blamed Fardin for wanting to seduce him, in an interview in 2018.
“I was a 16-year-old girl. What does justice ask of children? What do they film when they are abused?” she inquired.
