A man was left without two homes after more than two years of waiting for the building to be built. More than two years ago, Ognyan Stanoev signed a contract with a construction company for the purchase of two homes in the capital’s Druzhba district.

Indexing is never achieved. In February, Ognyan and many other clients were notified that their contract with the company had been unilaterally terminated.

“I want them to translate to me what we agreed on under the contract. Under the contract, when they terminate the contract, they have to pay penalties of 20%,” Stanoev added.

After more than two weeks, Ognyan received his money, but without penalties.

“What is happening is that as real estate prices have risen a lot, the builders have seen that they can sell at much higher prices than they have signed, and therefore decide that it will be more profitable for them to terminate the contracts with the already existing clients “, pointed out Ognyan Stanoev.

Thus, Ognyan is left without housing, which he has been waiting for more than two years. According to lawyer Veska Voleva, the preliminary contract does not give the right of ownership over the property and so the buyer’s hands are tied.

“When you have not bound it with a notary transaction, you are nobody under these agreements. I am firmly against the preliminary contracts on the construction site, because then nothing is sold to you. A preliminary contract is concluded when the object is in person, when possession of the respective person “, said the lawyer Veska Voleva.

Ognyan is adamant that he will seek his rights in court. According to lawyer Voleva, however, the case could drag on for years.

“Not to mention that there are fees. Not to mention that there are an awful lot of things. The company could go bankrupt during this time. They will transfer the sites and there will be no one to object to guarantee your claim,” the lawyer added.

According to her, the best option before buying a property is for the client to consult a lawyer and insist on the transfer of ownership. The construction company declined to comment on the case.
